But keep in mind that every case is different, and the value of your claim will depend on your individual facts and circumstances:
A 34-year-old client encountered a tractor while riding his dirt bike on a desert road. The tractor driver hit the client with his truck’s bucket, knocking the client off his bike.
The client sustained a fracture to his tibia, which required surgery, and a fracture to his foot and back. His injuries will require future full knee replacement. Atticus secured a $600,000 settlement for the client.
A husband and father of two children was on his way to work in Irvine, CA when he was rear-ended by a van that was being operated by a construction company. The incident was captured on the Tesla’s rear view video cameras. Atticus’s client initially did not feel any serious injuries and walked to work from the scene of the accident. Several days later, Atticus’s client complained of wrist pain and neck and back pain. His past history included some complaints for carpal tunnel syndrome which had resolved years before the incident. The Defendant, represented by State Farm Insurance, argued that Atticus client’s injuries were pre-existing and unrelated to the incident. They also argued the injuries were not severe. The jury disagreed and unanimously awarded nearly $550,000 to Atticus’s client.
Atticus represented a well-known and established paralegal that was on her way to an unrelated doctor appointment when she was sideswiped by the Defendant. The impact did not initially appear significant and Atticus’s client’s vehicle did not stop or move from the lane it was driving in. The impact did, however, cause Atticus’s client to twist her arm on the steering wheel and push her right hip into her seatbelt. As a result, she unfortunately needed surgery for both body parts years later. After a nearly month-long trial, a jury in Orange County awarded Atticus’s client nearly $700,000 in damages.
A wife and mother of three children was on her way to a dentist appointment when a tow truck driver fell asleep at the wheel. The result was terrifying and a story Atticus’s client does not wish to relive. The impact of the vehicles occurred near an off ramp on the I-5 freeway in Anaheim, CA. Atticus’s client suffered a fractured wrist requiring the need for surgery and severe back injuries requiring painful injections. After nearly two weeks in trial, Atticus secured a $2,500,000 jury verdict for a well deserved client.
A collision occurred at an intersection, leaving the client with injuries requiring future surgery. The insurance company offered the client only $80,000 in compensation, significantly undervaluing the client’s claim.
Atticus helped the client take the case to trial, and the jury awarded a verdict of $429,000. The insurance carrier agreed to resolve the case and paid a total of $500,000 to account for the excess verdict, costs, and attorney fees.
In a car accident, a client suffered a compression fracture to her spine. Her fracture healed without surgery but left her with some residual pain. The at-fault driver was uninsured, so we sought compensation under the client’s uninsured motorist benefits.
The case went to arbitration, where the defendant argued the case was worth only $100,000. However, the arbitrator ultimately awarded our client $351,782 in damages.
A dangerous Orange County sidewalk caused a 72-year-old client to fall onto her elbows, knees, and face. The sidewalk where she fell had an uplift of nearly 1 inch and an unsafe slope. Using images from Google Earth, we were able to show that the lift in the sidewalk was caused by a tree, which was removed a year before the accident. A nearby business owned the sidewalk, but a public entity had responsibility for maintaining it. But neither party had repaired the sidewalk after removing the tree. The defendants tried to argue that the sidewalk was safe and that our client had a history of falls. However, Atticus secured a $350,000 settlement for the client.
Atticus represented a minor that was playing outside in a street near his home with friends. Without any warning, Atticus’s client noticed a dog get loose from a nearby neighbor’s fenced yard and charge after him. The dog attacked Atticus’s client and bit his left thumb causing the minor client to need immediate care at a local hospital. Atticus was able to seek compensation from the homeowners insurance company and renter’s insurance company for the dog owner and the landlord of the home from where the dog escaped.
Personal injury settlement amounts and examples can give you a good idea of an attorney’s potential. However, settlement amounts can vary widely depending on the case’s specific circumstances. Many California personal injury settlements include compensation for medical expenses, lost earning capacity, and pain and suffering. The following factors are most likely to influence the amount of your injury settlement, including:
For example, a settlement for a minor injury such as a sprained ankle might settle for a few thousand dollars. A more severe injury, such as a spinal cord or traumatic brain injury, might settle for millions of dollars. Because each case is different, only a lawyer experienced in negotiating settlements can tell you what your case is worth.
